Public Offer Agreement

Republic of Kazakhstan, Almaty — effective from June 2, 2026

The ALTUSKETO service (hereinafter referred to as the 'Contractor', details in Section 13), and the individual accepting this offer (hereinafter referred to as the 'Customer'), jointly referred to as the 'Parties', have concluded this Public Offer Agreement (hereinafter 'Agreement').

1. General provisions

1.1. In accordance with Article 395 of the Civil Code of the Republic of Kazakhstan, this Agreement is a public offer. Full and unconditional acceptance of its terms (under Art. 396) occurs when the Customer performs any of the following: places an order on altusketo.kz, pays for services, or physically receives the delivered products.

1.2. By accepting the Agreement, the Customer confirms their legal capacity and right to enter into contractual relations with the Contractor.

1.3. Acceptance is equivalent to concluding a written contract and implies full agreement with all its provisions.

1.4. If you disagree with any clause, please refrain from accepting the offer and contact the Contractor to negotiate individual terms.

2. Subject of the agreement

2.1. The Contractor undertakes to provide services including: preparing a customized keto diet, selecting products considering allergies/preferences, packing, and delivering the products. The Customer undertakes to pay for these services.

2.2. The list of services, plans, and terms of provision are available on the altusketo.kz Site.

2.3. Service languages: Russian, Kazakh.

3. Rights and obligations of the Contractor

3.1. The Contractor is obliged to:

  • Provide quality services according to the chosen plan;
  • Ensure compliance with sanitary requirements during preparation and packaging;
  • Deliver products to the address and within the timeframe specified on the Site;
  • Accommodate allergies and intolerances specified by the Customer.

3.2. The Contractor has the right to:

  • Amend service terms and documents, providing at least 10 days' notice via Site publication;
  • Replace meal components with nutritionally equivalent ones, upon agreement with the Customer;
  • Accept payments from third parties as agreed with the Customer.

4. Rights and obligations of the Customer

4.1. The Customer is obliged to:

  • Pay for services fully and in a timely manner;
  • Provide accurate information on allergies, intolerances, and special dietary requests;
  • Specify the correct delivery address and time;
  • Review the rules and conditions posted on the Site.

4.2. The Customer has the right to:

  • Refuse the service in accordance with Kazakhstan law;
  • Specify individual dietary restrictions;
  • Contact the Contractor for consultation and support.

5. Cost and payment procedure

5.1. Service costs, payment procedures, and terms are in the 'Plans' section. The cost includes preparation, packaging, and delivery.

5.2. All payments are made via bank transfer in tenge, using the details on the Site.

6. Order cancellation

6.1. If an order is canceled, the cost of the canceled portion is refunded using the original payment method.

6.2. Order changes/cancellations must occur at least 24 hours before the scheduled delivery. Otherwise, the Contractor retains the cost of expenses incurred to prepare the order.

6.3. For the 'Transformation' plan, services can be paused ('frozen') with 48 hours' notice. Unused meal days are transferred to the subsequent period without loss.

7. Returns and refunds

7.1. Under Kazakhstan law, quality food products cannot be returned or refunded.

7.2. Returning defective products: If the products are of inadequate quality, the Customer may return them before the expiration date for a full refund or replacement. Refunds take up to 10 business days.

7.3. Incorrect items: If the order contains incorrect items, the Customer may accept or reject them and request a replacement or refund for the missing items.

7.4. Incomplete orders: If items are missing, the Customer may request delivery of the missing items or a refund. The shortage must be recorded in a document signed by the Customer and courier.

8. Delivery

8.1. Delivery occurs daily in the evening (approx. 18:00–20:30) the day before meal consumption.

8.2. Since meals are prepared to order, the earliest available start day is the day after tomorrow.

8.3. Delivery is included. The free delivery zone in Almaty is defined by the VOAD - Al-Farabi - Saina - Ryskulova boundaries. Delivery outside this area is subject to individual terms.

8.4. Products are delivered in thermal packaging (cooler bags). Containers are made of primary polypropylene produced in Kazakhstan.

9. Product quality and composition

9.1. All meals are made from natural ingredients, primarily grass-fed meat, and olive/sesame oils. Trans fats are completely excluded.

9.2. All recipes strictly adhere to the ketogenic protocol (macronutrient ratios) to ensure sustained ketosis.

9.3. Only safe sweeteners are used: erythritol, allulose, and stevia.

10. Liability of the parties

10.1. Ответственность Сторон за неисполнение или ненадлежащее исполнение обязательств по Договору регулируется действующим законодательством Республики Казахстан.

10.2. Disputes are resolved through negotiations. If unsuccessful, they will be referred to the court at the Contractor's location.

10.3. Parties are exempt from liability in the event of force majeure.

11. Personal data

11.1. By concluding the Agreement, the Customer consents to the processing of personal data in accordance with the Site's Privacy Policy.

11.2. Data processing is carried out per Kazakhstan Law No. 94-V 'On Personal Data and their Protection'.

12. Final provisions

12.1. The Agreement comes into force upon acceptance and remains valid during the provision of ordered services.

12.2. The Contractor may unilaterally change terms, notifying the Customer via the Site. Changes are deemed accepted if not contested within 10 days.

12.3. The Agreement may be terminated by mutual consent at any time.

12.4. The Agreement is in Russian. In case of translations, the Russian text prevails.
